Tribunal Report

The official Students’ Union Tribunal decision was released in late May, a month after the hearing was held. The decision overturned the earlier SU Review Board’s decision in favor of Phil Barski’s petition to throw out the 2004 SU General election.

Barski, a failed SU presidential candidate, filed the petition to overturn the election results alleging computer error in the on-line voting system. The error potentially could have allowed some voters to cast more than one ballot, or denied the vote to others.

Although the Tribunal decision acknowledged evidence of three students unable to vote, therefore violating an SU Election bylaw, it further declared that “the Respondent [Barski] did not establish enough evidence of actual voting errors (versus possible voting errors) to… find that the election results were materially affected.”
